Local prosecutor weighs in on swimmer sentence
DAYTON, Ohio (WDTN) – The Montgomery County Prosecutor released a letter Friday addressing the recent sentencing of an Oakwood native in a sexual assault that has gained national attention.

The letter was signed by both Prosecutor Mat Heck and the director of the victim/witness division, Sandra Hunt.
In the letter Heck addresses the sentencing of Brock Turner saying, “We, like many of out colleagues throughout the country, believe that the disappointing and inappropriate sentence in that case will have a chilling effect on victims coming forward to report sexual violence.”
The letter goes on to point out statistics that show as much as 85-percent of on-campus sexual assaults go unreported and please for more education on the law and the meaning of consent.
Heck also reminds people the prosecutor’s office provides 24-hour crisis hotline and 24-hour response to all sexual assault victims who report to hospital emergency departments. You can call that hotline anytime at (937) 225-5623.

Woman dies after getting speared by runaway beach umbrella
VIRGINIA BEACH, VA (WAVY) — Police say a woman died after wind blew an anchored umbrella into her chest on the Oceanfront Wednesday.
According to authorities, dispatchers received a call for service around 5:07 p.m. for a woman in cardiac arrest on the beach at 33rd Street.
Police say an investigation revealed that a 56-year-old woman from Chester, Virginia, was on the beach when a strong gust of wind blew an anchored beach umbrella across the sand, hitting the victim. When medics arrived, they found the woman suffering from a life-threatening injury.
She was transported to a local hospital, but ultimately succumbed to her injury.
Police are investigating the incident. There is no evidence of foul play, according to police.

PIERRE PART, LA (WCMH) – Hollie Mallett’s security cameras caught a repeat offender–a boy who kept coming into her garage to play with her dog.
The boy is seen pulling up on his bicycle, dashing into Mallett’s garage in Louisiana to hug her dog, and then bolting off.
“Anyone know who this sweet little boy is?” she wrote on Facebook. “Every now and then when he rides his bike he will quickly come and love on my dog or play fetch real quick, but always leaves quick like he doesn’t know if he should be here! I’d like to tell him he’s welcome to stay and play, she loves the attention!”
Friends of hers on Facebook recognized the boy, named Josh, and got his mother in on the conversation.
The boy’s mother, Ginger Breaux, said on Facebook that her son talked about the dog every day when he passed by.
“I’m torn with my heart melting that he adores dogs so much AND with feeling upset that his little booty shouldn’t be going on someone’s property without permission or without me knowing,” she wrote on her own page.
Breaux said her family’s dog passed away last year. The family hasn’t had the time to get a new puppy,
Austin Texas valedictorian graduation tweet goes viral
AUSTIN (KXAN) — The valedictorian of Crockett High School’s 2016 class has the spotlight on her after tweeting about being “undocumented” on the night of her graduation.
Mayte Lara Ibarra, who was also the senior class president, tweeted on June 3: “Valedictorian, 4.5GPA, full tuition paid for at UT, 13 cords/medals, nice legs, oh and I’m undocumented” along with several emojis including the Mexican flag.
Her tweet received nearly 20,000 likes and 9,000 retweets. According to the Daily Mail, after her tweet went viral and some people started sending negative responses, Ibarra tweeted, “I want all this attention from strangers to stop already.” Ibarra has since removed her Twitter account.
One of Ibarra’s classmates posted on Facebook supporting Ibarra.
During Crockett High’s graduation ceremony, Ibarra introduced the Pledge of Allegiance as well as the National Anthem. She came back up to the podium to give her valedictorian speech a short time later. During her speech, she mentioned the hard work her class put in and what their future might hold, but she didn’t mention anything about her immigration history. In closing, Ibarra said, “What is coming is better than what is gone. Congratulations class of 2016.”
Undocumented students are protected under the Deferred Action for Childhood Arrivals Program (DACA). In 2012, the Secretary of Homeland Security announced that certain people who came to the U.S. as children and meet several guidelines may request consideration of deferred action for a period of two years. In Texas, House Bill 1403—which passed in 2001 and is also known as the DREAM Act—allows certain immigrants to receive in-state tuition if they meet certain requirements.
Last year, the DREAM Act came under scrutiny at the Capitol when some state lawmakers were pushing for the repeal of the law.
A spokesperson for the University of Texas at Austin says while they can’t say anything specifically about Ibarra, the university along with other Texas universities, “have for decades granted two-semester tuition waivers to valedictorians of Texas public high schools, without regard to their residency status. State law also does not distinguish between documented and undocumented graduates of Texas high schools in admissions and financial aid decisions. University policies reflect that law.”

Man shot in back in Jefferson Township
JEFFERSON TOWNSHIP, Ohio (WDTN) – One person has been hospitalized after being shot late on Wednesday night in Jefferson Township.
It happened just before 11 p.m. on Wednesday in the 700 block of Calumet Lane.
The Montgomery County Sheriff’s Office says a man was shot in the back.
The victim was taken to Miami Valley Hospital by the Jefferson Township Fire Department.
His injuries are believed to be non-life threatening.
Sheriff’s deputies removed a person of interest from the scene and questioned them at the time of the shooting.
The incident is still under investigation.

CLEVELAND, Ohio – LeBron James had 32 points, 11 rebounds and six assists to help power the desperate Cleveland Cavaliers to a 120-90 victory over the Golden State Warriors in Game 3 of the NBA Finals on Wednesday night.
Kyrie Irving shook off his struggles in the first two games to finish with 30 points and eight assists for the Cavaliers, who were blown out in the first two games of the best-of-seven series in Oakland. J.R. Smith scored 20 points and Tristan Thompson added 14 points and 13 rebounds.
The Cavaliers lost the first two games by 48 combined points. But they played much better defense on Wednesday night while missing starting power forward Kevin Love, who sat out with a concussion.
Stephen Curry struggled mightily with 19 points on 6-for-13 shooting and six turnovers. Klay Thompson had just 10 points and went scoreless in three of the four quarters.
Game 4 is Friday night in Cleveland.

Brock Turner’s father started account to help with legal costs
OAKWOOD, Ohio (WDTN) – With a population just over 9,000 people, Oakwood is small, tight-knit community with growing families and some of the best performing schools in the county.
But that community has been rocked to it’s core after learning one of their own–20-year-old Brock Turner–was found guilty of 3 felony sexual assault crimes. A judge sentenced Turner to six months in jail — sparking outrage by many on social media.
A Change.org petition to remove the judge from the bench has now gathered more than 700,000 signatures. We reached out the family and knocked on their doors, but there was no answer.
We we’re able to speak with one former neighbor in their old neighborhood — who didn’t want to go on camera — but did say she’s in support of the family. She says she knew the family before this incident and she supports the father’s decision to write to the judge.
In the meantime, a support page was set up on Facebook to help fund the family’s legal fee’s but that page has been taken down. We reached out to the woman who started the page but haven’t heard back.
However, we were able to confirm with Wright-Patt Credit Union that the Turner Family Support Fund does exist. According to the bank, the account is active and in the name of Brock Turner’s father Dan Turner.
We reached out to the family by phone, but have yet to hear from them.

Police dispatchers tell 2 NEWS one lane is back open and the fire is out. Dispatchers also said they were unaware of any injuries.
The fire happened before 4 p.m. Wednesday on the southbound side near Dryden Road.

Police investigate 2 break-in attempts
HUBER HEIGHTS, Ohio (WDTN) – Huber Heights Police are investigating two crime scenes on Brandt Pike.
Police responded to an alarm at Cricket Wireless in the 6400 block of Brandt Pike around 4:15 a.m. on Wednesday.
When they arrived, they found damage to the glass front door of the business.
Investigators say it appeared someone threw a rock through the door.
Nearly 15 minutes later, an officer on patrol found the front glass door of Metro PCS in the 5100 block of Brandt Pike also shattered by a rock.
At both crime scenes, nothing appeared to be taken.
Police say both crimes likely happened between 4-4:30 a.m.
Officers are investigating both criminal damaging incidents as possible attempted breaking and entering scenes.

Leopard escapes at Utah zoo; visitors take shelter
SALT LAKE CITY (AP) — Hundreds of Salt Lake City zoo visitors took shelter inside buildings Tuesday morning after a rare leopard escaped and fell asleep on a beam just above where visitors would have gathered to watch her.
A visitor spotted the 4-year-old female snoozing on the outdoor beam about two feet from the exhibit, Hogle Zoo spokeswoman Erica Hansen said. She told a zookeeper, who raised the alarm.
An emergency team tranquilized the Amur leopard, packed her into a crate and took her to a holding area.
No one was hurt, and the leopard named Zeya is expected to be fine after the tranquilizer wears off, said Nancy Carpenter, associate director of animal health at the zoo. The animal instinctually hung onto the beam after the tranquilizer dart struck, leaving visible claw marks on the wooden beam.
She eventually fell the final three feet to the ground and landed in a garden area between the visitor fence and her mesh enclosure.
Hansen said they don’t yet know how or when the leopard managed to get through the tall steel-grade mesh that surrounds the top and sides of her enclosure, but officials are investigating.
The reports of a wild animal on the loose caused quite a commotion on social media, and even spawned a parody Twitter account. The first tweet by the account, HogleZooLeopard, said “I’m finally free!”
But zoo visitors who were inside said the situation played out calmly and orderly.
Stephanie Gardner said she was looking at the giraffes at the zoo when a staff member told her and her family to take shelter in the gift shop with about 40 other people because of a situation. She said there was “no chaos or anything.”
Steve Jones said he and his family were at the monkey exhibit when zoo staff told them to get inside the bistro. They waited inside with several hundred people. Kids were playing, he said.
“We never did feel in danger,” Jones, 63, of South Jordan, Utah, said.
The leopard was reported missing at 9:30 a.m. It was captured, and people were allowed out of buildings about an hour later, Hansen said. It’s not clear exactly how long she was out, but zoo staff saw her inside the enclosure at about 7 a.m. The animal was spotted outside her enclosure shortly after the zoo opened to the public.
There are two Amur leopards at the zoo. Hansen said the other leopard is in a separate enclosure and did not escape.
The leopard that escaped is a petite, 60-pound animal that has only been at the zoo for a few years. She was brought in from a sanctuary in England to mate with the other Amur leopard, she said.
Amur leopards are considered critically endangered, according to the conservation organization World Wildlife Fund. There are only about 60 of them left in the wild.
Hansen said it is rare for animals to get loose at the zoo. In 2006, the zoo was evacuated when a gray wolf scaled the wall of her pen. The animal was shot with a tranquilizer dart and captured within zoo boundaries after about an hour. No one was hurt in that incident.
In 1999, three chimpanzees at the Salt Lake City Zoo escaped through an unlocked enclosure door and attacked and injured two zoo workers. Zoo employees fired shotguns instead of tranquilizer darts at two of the chimps, which were then euthanized. A third chimp was relocated to a Kansas zoo, and the U.S. Department of Agriculture issued a mild reprimand to the zoo for failing to keep the enclosure secured.
The zoo hasn’t had chimpanzees since that incident, Hansen said.
Last month, a zoo in Cincinnati shot and killed a gorilla when a young boy got into its exhibit and was dragged by the 400-pound animal.
While the leopard was quickly contained in Utah on Tuesday, if the animal had actively threatened people zoo officials would have used lethal force, Carpenter said.
The lines outside the Utah zoo grew long during the hour-long shut down, but the zoo has since re-opened. Many people returned to finish their outing after staff gave the all-clear signal.
The U.S. Department of Agriculture last inspected the zoo on May 3 and found no violations.
